Creators who sell assets on itch.io will now have to disclose much more about the use of generative AI. The marketplace for independent digital creators has introduced a new rule that requires users to label their projects if they were created using generative AI tools such as ChatGPT and Midjourney. When users upload their projects, they will see a field to disclose AI generation. If they confirm that their project contains AI-generated data, they will need to specify what kind of content was created using generative AI: graphics, sounds, text, dialogs, or code.

If they have a public resources page, they will see a dialog box when they access their dashboard that allows them to easily add tags to their projects. They will be able to select multiple projects from their list and then indicate whether or not they contain AI-generated content. All resources with AI outputs will be tagged “Created by AI,” while those without will be labeled “Without AI.” Each type of content will also have its own subtag.

itch.io requires that all resources that have used artificial intelligence in some way, even if the creator has edited them manually, be labeled as AI Generated. And if it finds any unlabeled work that used an artificial intelligence tool, it will make that resource unable to be indexed so that potential buyers can no longer find it. However, it is unclear what measures the marketplace is taking to control its site. Although itch.io’s new policy may not be enough for those who prefer to ban AI content completely, tags will allow buyers who do not want to use AI assets in their work to filter them out.
