Ukraine is preparing to regulate artificial intelligence

A team of experts has developed recommendations that will help create and use artificial intelligence innovations while respecting intellectual property rights.

“Copyright infringement is one of the hottest issues in the field of artificial intelligence. There have been dozens of high-profile lawsuits against tech companies by famous writers, artists, and even programmers for the misuse of intellectual property,” says Deputy Minister of Digital Transformation Oleksandr Borniakov.

According to him, ordinary users of AI systems that have generated a picture or text can also violate copyright. To protect citizens and IT companies from such cases, the team has developed tips on how to work with AI tools without risks.

How not to violate intellectual property

Experts have collected tips on how to responsibly use intellectual property to train AI models. Content rights holders can learn how to protect their photos, videos, texts, audio, and other objects from misuse by AI systems. The document also contains tips on what to look for when generating content in AI systems.

“Ukraine has made an important step in the field of intellectual property rights by becoming one of the first countries to define a legal regime for objects created by artificial intelligence (AI),” said Vitaliy Kindrativ, Deputy Minister of Economy of Ukraine.

On January 1, 2023, the Law of Ukraine “On Copyright and Related Rights” came into force, introducing a sui generis regime to protect non-original works created by computer programs.

“The Ministry of Economy has joined the development of recommendations for developers, rights holders and users to promote the responsible use of AI, protect the interests of all parties and prevent possible infringements, given the rapid development of AI in Ukraine,” Kindrativ adds.

Who the recommendations are for

The recommendations will be useful:

  • IT specialists and companies that develop products using artificial intelligence
  • authors, i.e. all those who create pictures, photos, video and audio works, etc., and other content rights holders
  • users of artificial intelligence systems
  • lawyers and other professionals in the field of intellectual property

“Recommendations on the Responsible Use of AI: Intellectual Property Issues” is one of the tools from the state that will help businesses prepare for the regulation of artificial intelligence in Ukraine. Who developed it

The document was developed by representatives of government agencies, specialized associations, academic institutions and public organizations, including the Ministry of Digital Transformation of Ukraine, the Ministry of Economy of Ukraine, the Expert Advisory Committee on Artificial Intelligence Development under the Ministry of Digital Transformation, the Ministry of Economy of Ukraine, the Ukrainian National Office of Intellectual Property and Innovation (UKRNIPI), the IT Ukraine Association, the Ukrainian Bar Association, the Center for Democracy and Rule of Law (CEDEM), the Department of Intellectual Property, etc. The authors are listed in the recommendations.

The recommendations were developed with the support of the Digital Transformation Support Project, funded by USAID and UK Dev. The project partner is the East Europe Foundation.
